Service Terms and Conditions for Waste Collection Pimlico
These Terms and Conditions set out the basis on which Waste Collection Pimlico provides waste collection and related services to residential and commercial customers. By placing a booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
"Company" means Waste Collection Pimlico, the waste removal and collection service provider.
"Customer" or "you" means the person, business, or organisation requesting or receiving services from the Company.
"Services" means any waste collection, rubbish removal, clearance, recycling, or associated work supplied by the Company.
"Waste" means any materials, items, rubbish, junk, refuse, or other substances presented by the Customer for collection and disposal, subject to relevant regulations.
"Booking" means a confirmed request by the Customer for the Company to provide Services, whether made by telephone, email, online form, or any other method accepted by the Company.
2. Scope of Services
The Company provides waste collection, rubbish removal, and related services within Pimlico and surrounding areas, subject to availability. Services may include domestic waste collection, commercial waste removal, bulky item collection, garden waste clearance, and other agreed waste services.
The exact scope of the Services for each Booking will be based on the information supplied by the Customer at the time of booking, including the type and approximate volume or weight of waste, access conditions, and any special requirements.
The Company reserves the right to refuse or suspend Services where waste is incorrectly described, where access is unsafe, or where providing the Services would breach any law or regulation.
3. Booking Process
Bookings can be made by telephone, email, or through the Company’s online booking or enquiry systems where available. When making a booking, the Customer must provide accurate information about:
1. The address where Services are to be performed.
2. The type of property and access details, including any parking or entry restrictions.
3. The nature of the waste, including its type, approximate quantity, and any items that may be hazardous or require special handling.
4. The preferred date and time window for the waste collection.
The Company will provide an estimated price based on the information supplied. This estimate may be subject to change if, on arrival, the waste volume, type, or access conditions differ substantially from the description given. Any change in price will be explained to the Customer before the Services are carried out, and the Customer will have the option to accept the revised price or cancel the Booking in accordance with these Terms.
A Booking is considered confirmed when the Company has accepted the request and, where required, received any applicable deposit or prepayment. The Company may decline a Booking at its discretion.
4. Customer Responsibilities
The Customer is responsible for:
1. Ensuring that the waste to be collected is accurately described at the time of booking.
2. Providing safe and adequate access to the premises for the Company’s staff and vehicles at the agreed time.
3. Complying with any instructions given by the Company in relation to the segregation, storage, or presentation of waste for collection.
4. Obtaining any necessary permissions, permits, or authorisations for the collection to take place, including parking permissions where required.
5. Ensuring that no prohibited or unlawful items are included in the waste, such as certain hazardous materials, controlled substances, or items requiring specialised disposal not agreed in advance.
Where the Customer fails to provide proper access or where waste has been misrepresented, the Company may charge a call-out fee, a waiting time charge, an additional loading fee, or cancel the Booking, in each case at its discretion.
5. Pricing and Payments
All prices are quoted in pounds sterling and may be subject to applicable taxes. Prices are generally based on the volume or weight of waste, type of materials, labour involved, and any disposal or recycling charges.
The Company will provide an estimated price prior to confirming the Booking. This estimate is based on the Customer’s description and may be adjusted on site if the actual waste quantity, type, or loading conditions differ. Any revised price will be communicated to the Customer before work proceeds.
Unless otherwise agreed in writing, payment is due immediately upon completion of the Services. The Company may require a deposit or full prepayment at the time of booking, particularly for larger clearances or commercial work.
Accepted payment methods may include cash, debit or credit card, bank transfer, or other methods notified by the Company. The Customer agrees to pay all amounts due in full and without set-off or deduction.
Where payment is not received when due, the Company reserves the right to charge interest on overdue amounts, recover reasonable costs of debt collection, and suspend or terminate further Services until all outstanding sums are settled.
6. Cancellations and Amendments
The Customer may cancel or amend a Booking by notifying the Company as soon as reasonably practicable. The following cancellation terms will generally apply:
1. If the Customer cancels more than 24 hours before the agreed arrival time, any deposit may be refunded at the Company’s discretion, less any reasonable administration costs.
2. If the Customer cancels less than 24 hours before the agreed arrival time, the Company may retain all or part of any deposit and may charge a late cancellation fee to cover wasted time and travel costs.
3. If the Customer fails to provide access at the arranged time, or is not present where required for access or payment, this may be treated as a cancellation and a call-out or cancellation fee may be charged.
Where the Customer requests amendments, such as a change to the collection time, date, or quantity of waste, the Company will use reasonable efforts to accommodate the change but cannot guarantee availability. Any amendments may result in a revised price.
The Company reserves the right to cancel or reschedule a Booking at any time due to adverse weather, vehicle breakdown, staff illness, regulatory issues, or other circumstances beyond its reasonable control. In such cases, the Company will aim to offer an alternative appointment or a refund of any prepayments for Services not delivered.
7. Waste Regulations and Prohibited Materials
The Company operates in accordance with relevant UK waste management legislation and regulations, including the duty of care for controlled waste, requirements for waste transfer notes where applicable, and obligations relating to recycling and environmentally responsible disposal.
The Customer must not present any waste that is illegal to transport or dispose of, including but not limited to:
1. Certain hazardous or toxic substances not agreed in advance.
2. Asbestos or materials containing asbestos, unless specifically agreed and subject to appropriate arrangements.
3. Clinical, medical, or biological waste.
4. Gas bottles, pressurised containers, or similar items that pose safety risks without prior agreement.
5. Any materials whose possession or disposal is prohibited by law.
If such materials are discovered during the collection, the Company may refuse to handle them, adjust the price, or terminate the Services immediately. The Customer may be charged for time on site and any costs incurred in dealing with prohibited items already loaded.
The Company will use licensed facilities for the transfer, recycling, and disposal of waste and will seek to maximise recycling and recovery in line with industry practice and regulatory requirements.
8. Liability and Limitations
The Company will exercise reasonable care and skill in providing the Services. However, the Company’s liability to the Customer is subject to the limitations set out in this section.
The Company will not be liable for any indirect, consequential, or purely economic losses, including loss of profit, loss of business opportunities, or loss of goodwill, arising out of or in connection with the provision of the Services.
The Company will not be responsible for any damage to items that the Customer has asked to be removed as waste, including items that may later be found to have sentimental or financial value. It is the Customer’s responsibility to ensure that only unwanted items are presented as waste.
The Company shall not be liable for any damage to driveways, access routes, or surfaces caused by the weight or movement of vehicles or equipment, provided that such vehicles or equipment are operated with reasonable care and in circumstances where the Customer has requested or agreed to the use of those access routes.
Nothing in these Terms and Conditions excludes or limits the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded under UK law.
Subject to the above, the total liability of the Company to the Customer in respect of any claim arising out of or in connection with the Services shall not exceed the total amount paid by the Customer for the specific Booking giving rise to the claim.
9. Access, Health and Safety
The Customer must ensure that the area where Services are to be carried out is reasonably clear and safe for the Company’s staff. The Company reserves the right to refuse to carry out Services in areas that are considered unsafe or where conditions pose a risk to health and safety.
If access to the property or waste requires entry through neighbouring land, shared spaces, or restricted areas, it is the Customer’s responsibility to obtain any necessary permissions. The Company is not responsible for any disputes or claims arising from access arrangements that the Customer has failed to secure properly.
The Company may at any time suspend or modify the provision of Services if required to comply with health and safety laws, local restrictions, or reasonable safety concerns.
10. Data Protection and Privacy
The Company may collect and process personal data about Customers in order to handle enquiries, manage bookings, and provide the Services. This may include contact details, service addresses, payment information, and details of the Services provided.
The Company will take reasonable steps to keep personal data secure and will use such data only for legitimate business purposes, including service delivery, administration, and legal or regulatory compliance. Personal data may be retained for as long as reasonably necessary for these purposes.
Customers have certain rights under UK data protection law, including rights of access and correction in relation to their personal data, subject to applicable conditions.
11. Force Majeure
The Company shall not be liable for any delay or failure to perform its obligations under these Terms and Conditions where such delay or failure is due to events beyond its reasonable control. This may include, without limitation, extreme weather, fire, flood, strikes, industrial disputes, pandemics, accidents, road closures, vehicle breakdowns, or actions of public authorities.
Where a force majeure event occurs, the Company may suspend the Services for the duration of the event or, if necessary, cancel the Booking. The Company will use reasonable efforts to inform the Customer and to rearrange Services where practical.
12. Variations to Terms
The Company may update or revise these Terms and Conditions from time to time. Any changes will take effect from the date they are published or otherwise communicated and will apply to all Bookings made after that date. For ongoing or long-term service arrangements, the Company will notify the Customer of any material changes where reasonably possible.
13. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.
Both the Company and the Customer agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the Services, except that the Company may also bring proceedings in any other jurisdiction where it is lawful to do so in order to enforce its rights, particularly in relation to unpaid charges.
14. General Provisions
If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy, nor shall any single or partial exercise of any right or remedy prevent any further exercise of it.
The Customer may not assign or transfer any of its rights or obligations under these Terms and Conditions without the prior written consent of the Company. The Company may assign or subcontract its rights and obligations where reasonably necessary for the provision of the Services.
These Terms and Conditions, together with any written confirmation of Booking and agreed service details, constitute the entire agreement between the Company and the Customer in relation to the Services and supersede any previous discussions, correspondence, or understandings.
